I agree with your submission, but unfortunately many of those who are against some professions to be recognised as procurement experts, have not actually looked into detail what people in other fields have studied and outright regard them as having no enough knowledge to be procurement experts.

The key words in the definition given in the Public Procurement Act have been highlighted in red below

”means a person who is engaged in a profession, occupation or calling in which recourse to procurement is directly or indirectly involved and has such knowledge and experience of the practice of procurement and has been certified or registered by the procurement professional body"

The meaning of that statement is that nobody will operate a a procurement expert or specialist unless he has been certified and registered by the procurement professional body, PSPTB. So with the current setup, and if PSPTB does their job properly and fairly, we will have the right people in the field.

Basically, this issue is debatable amongst the procurement practitioners, thankx to Mr RSM for raising this argument up. Before, I go far, dear forum allow me to quote my teacher Bakari MM, once told me``profession whatever it is, be engineering, economics, law, architecture, marketing, finance and accounting need to be tailored in conformance with the salient features of the profession itself’

From above quotation, am going to discuss who is the procurement expert while am keeping in mind that procurement as professional study has its salient standpoint concerning procurement expert. The qualities and meaning of procurement expert or specialist are clearly elaborated by PPA No. 21, 2004 and PSPTB Act No. 23, 2007 especially.

For better clarification and ease understanding about ``who is a procurement expert’’ between and amongst the procurement practitioners, my argument will be constructed through PSPTB Act No. 23, 2007.

PSPTB Act No. 23, 2007 provides a clear definition of the procurement expert or specialist as ``any person who is qualified in procurement and supplies management and is registered as procurement specialist’’ Register means that, procurement expert is supposed to be registered and recognized by an established professional body that is PSPTB (Formerly called NBMM) and not otherwise.

Procurement and supplies management means what? to procurement expert

``Procurement expert’’ is required to undergo special training, long and intensive preparation in skills as well as methods in the entire fields relating to the procurement and supplies management in order to be competent, independent, knowledgeable, registered and ultimately a certified procurement expert by professional and not by counterfeit. It doesn’t matter how person is familiar with PPA No. 21, 2004 and the attendant Regulations (GN No. 97 & 98 of 2005) or how much procurement transactions, he/ she has executed and then call herself or himself a Procurement expert. That`s wrong justification, Procurement expert should have a basic and complete knowledge, skills and ethical behavior that are generally accepted in procurement and supplies management for the better public service.

Dear forums, allow me to cite some sections from PSPTB Act No. 23, 2007 for more explanations.
As per S.46 (2) of PSPTB Act states that ``no person shall take up or continue in any employment in procurement or supplies activities unless he has been registered as procurement and supplies professional and technician’’

S.46 (3) of PSPTB Act further states `` a person who contravenes any of the provision of this sections commits an offence and shall be liable on conviction to a fine of not less than one million shillings and not more than three million shillings or to imprisonment for a term not exceeding two years or to both such fine and imprisonment.

According to Public Procurement Act procurement expert or specialist ”means a person who is engaged in a profession, occupation or calling in which recourse to procurement is directly or indirectly involved and has such knowledge and experience of the practice of procurement and has been certified or registered by the procurement professional body"

With this definition, who is indeed a procurement expert or specialist?

I am putting this for discussion for in certain quotas I have heard some people accusing some professions, particularly Engineers, for invading the procurement field.
